Tony Pittas and Nicola Hall – High Court Success in the Chancery Division

After a 3 day trial in the Chancery Division of the High Court, solicitors Nicola Hall and Tony Pittas obtained judgement on behalf of the Claimant executor of the will, proving that the will in dispute was the last will and testament of the testator. As well as winning the case costs were awarded to the Claimant against the Defendant and did not come out of the estate.

Tony Pittas, litigation solicitor at Hall & Co acted in a claim against the Secretary of State  for Communities and Local Government and London Borough of Lambeth whereby the Secretary of State’s refusal to grant planning permission was challenged in the High Court. shortly prior to the hearing the Secretary of State confirmed that he would not be challenging our application any further and agreed to pay all of our client’s costs by way of a Consent Order.

Nicola Hall and Tony Pittas acted for a PLC being the largest in its field in the Western World in its purchase of a substantial commercial and office building. The transaction was carried out to a strict timescale at a cost of several millions of pounds.



Nicola Hall has acted for a number of buyers and sellers of properties on the Dulwich Estate.

Solicitor Nicola Hall at Hall & Co acted for an offshore company in the purchase of a substantial property in Mayfair. The transaction was a complex deal involving overriding leases and several firms of solicitors acting for various interested parties. It was completed within the strict time limits which the client wanted.

Litigation solicitor Tony Pittas wins case in the London Court of International Arbitration (LCIA). Hall & Co were instructed by an offshore company to pursue a substantial debt from a major foreign Bank involving a loan to the Bank of a figure in excess of $30million including interest.

All sums were recovered including interst and costs despite a defence of all possible points being presented on behalf of the Bank by one of the top 5 law firms in the country.



Court of Appeal success!!

Litigation solicitor at Hall & Co solicitors, Tony Pittas wins claim against the Secretary of State for the Communities in the Court of Appeal. In an important case dealing with expert evidence in planning appeals.

Giving the leading judgement Lord Justice Etherton (Lord Justice Mummery and Mr Justice Hedley concurring) reiterated that the required degree of particularity as to reasons depends entirely on the nature of the issues falling for decision. In this case he held that the inspector failed to give any reasons for rejecting the analysis and conclusions in the appellant’s expert’s report.  This failure to do so left the appellant in doubt as to the potential for a future application. Lord Justice Etherton held that decision letter left the appellant materially in the dark about its impact on obtaining some alternative planning permission in relation to the noise issue addressed in condition that was being challenged.

 

The judgement is also a salutary warning to ensure that even in the most basic (and increasingly common) form of planning appeals the courts will not require planning inspectors to search around to find alternative solutions or invite further representations from the parties to save or vary a planning permission to the advantage of an appellant. The onus is on an appellant and/or his advisors to ensure that all options are properly explored before an inspector. This means that appeal representations should be thorough prepared and parties should be careful to consider whether they have explored all aspects of their appeal in the material upon which they rely.
